Annual update of YKHC funding agreement for FTCA coverage

It is the time of year to update Section 3 of YKHC’s Funding Agreement with IHS. Sec. 3 describes the programs, services, functions, and activities (PSFAs) that make up the comprehensive health care services and social services that YKHC provides.  

We review this every year to make sure the document thoroughly and accurately describes the PSFAs we perform, and to update as necessary. One reason for this is that if there is a tort claim (i.e. personal injury/malpractice) against YKHC and/or employee(s) while performing a PSFA within their job descriptions at work, YKHC and the employee(s) should be covered by the Federal Tort Claims Act (FTCA), subject to exceptions.  This protects YKHC and you from personal liability.

It is broken up into subsections, such as Health Services, Support Services, HR, etc. Please review the section(s) that pertain to you and your team. If you feel additions, deletions, or modifications are necessary to cover the PSFAs your team performs now or will perform in FY23, please e-mail me with suggested edits (you can cut and paste from the Word document if you like – please track changes). We will compile the suggestions for review and submission to IHS as part of our annual negotiation with them in May.  You’ll notice some of the edits that were adopted last year in the pdf (redline). Please note, the sections are intentionally written with broad language to capture many different PSFAs. The idea is not to have a laundry list of PSFAs, but to make sure that everything we do is included within the broadly written language. 

You can find our facilities List (Appendix E) here. This document lists the facilities and places where we perform PSFAs.  If there are any new facilities or new places where we perform PSFAs, or will in FY 23, please let me know. Please also let me know if we’ve left any of the places behind and need to remove them from the list.
